Terms of Service
These Terms of Service (the “Terms”) govern your use of the website beyondbarcode.com (the “Site”) and, together with the applicable order form or service agreement, the Digital Product Passport platform and related services (the “Services”) provided by Beyond Bar Code (“Beyond Bar Code”, “we”, “us”). By using the Site or the Services you agree to these Terms. If you use the Services on behalf of a company, you confirm that you are authorised to bind that company.
1. Definitions
- Customer: the legal entity that has entered into an Order Form with Beyond Bar Code.
- User: any individual who accesses the Site or uses the Services, including Customer personnel and value-chain partners invited by a Customer.
- Platform: Beyond Bar Code’s hosted software for creating, managing, hosting and sharing Digital Product Passports (DPPs).
- Product Data: all data, documents and identifiers a Customer or its partners submit to the Platform, and the passports generated from them.
- Order Form: the document describing the modules, scope, fees and term agreed with a Customer. In case of conflict, the Order Form prevails over these Terms.
2. The Site
The Site presents our company and Services and lets you contact us or request materials. Its content is general information only and does not constitute legal or regulatory advice. Regulatory timelines and requirements described on the Site reflect our understanding at the time of publication and may change as EU delegated acts are adopted.
You may not use the Site in any way that damages, disables or impairs it, attempt to gain unauthorised access to it or to any related system, or use automated means to collect content from it beyond what search engines ordinarily do.
3. Access to the Platform
Access to the Platform is granted to Customers under an Order Form. Beyond Bar Code grants the Customer a non-exclusive, non-transferable right, for the term of the Order Form, to let its Users access and use the Platform for the Customer’s internal business purposes and for sharing passport data with authorities, partners and consumers as intended by the Services.
The Customer is responsible for its Users, for keeping login credentials confidential and for all activity under its accounts, and must notify us without undue delay of any suspected unauthorised use.
The Customer may not resell or sublicense the Platform, reverse engineer it except where the law allows, remove proprietary notices, or use it to build a competing product.
4. Product Data and regulatory responsibility
The Customer retains all rights in its Product Data. The Customer grants Beyond Bar Code the rights needed to host, process, structure, display and transmit Product Data in order to provide the Services, including making passport data accessible to the stakeholder groups the Customer designates or applicable law requires.
The Customer is responsible for the accuracy, completeness and lawfulness of its Product Data and for obtaining any rights and consents needed from suppliers and partners. Beyond Bar Code structures, hosts and makes passport data accessible; it does not verify the underlying facts unless an Order Form says otherwise.
The Services are designed to help Customers meet Digital Product Passport requirements under the ESPR, the EU Battery Regulation and related delegated acts. Legal responsibility for the regulatory compliance of a product remains with the manufacturer, importer or other economic operator. Beyond Bar Code does not guarantee that use of the Services will result in compliance in any specific case.
5. Fees
Fees, billing periods and payment terms are set out in the Order Form. Unless stated otherwise, fees are exclusive of VAT and payable within thirty days of invoice. We may suspend access after written notice if undisputed fees remain unpaid.
6. Availability, support and changes
We work to keep the Platform available and secure and may update it over time, including to reflect changes in standards (GS1 Digital Link, FIWARE, GAIA-X, EBSI and others) or regulation. Planned maintenance is announced where reasonably possible. Service levels, where agreed, are described in the Order Form.
7. Intellectual property
The Platform, the Site, our documentation, data models, trademarks and all related intellectual property belong to Beyond Bar Code or its licensors. These Terms grant no ownership rights. Feedback you give us may be used to improve the Services without obligation.
The Platform builds on open standards and may incorporate third-party or open-source components, which remain subject to their own licences. References to standards bodies or partners do not imply endorsement by them.
8. Confidentiality and data protection
Each party keeps the other’s confidential information confidential and uses it only for the purposes of the Services. Personal data is processed as described in our Privacy Policy; where Beyond Bar Code processes personal data on the Customer’s behalf, a data processing agreement forms part of the Order Form.
9. Warranties and disclaimers
We provide the Services with reasonable skill and care. Except as expressly stated in these Terms or an Order Form, the Site and the Services are provided “as is”, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement to the extent permitted by law.
10. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, revenue or data, or for regulatory fines arising from the other party’s own non-compliance. Beyond Bar Code’s total liability under an Order Form is limited to the fees paid by the Customer under that Order Form in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, wilful misconduct or any liability that cannot be limited by law.
11. Term, suspension and termination
These Terms apply for as long as you use the Site or the Services. Order Forms run for the term stated in them. Either party may terminate an Order Form for a material breach that is not remedied within thirty days of written notice. We may suspend access where necessary to protect the Platform or other customers, or to comply with the law.
On termination the Customer’s access ends. We make Product Data available for export for thirty days after termination, after which we may delete it, unless a longer retention is required by law or agreed in the Order Form.
12. Changes to these Terms
We may update these Terms. The current version is published on this page with its date. Material changes affecting Customers with an active Order Form are notified in writing at least thirty days before they take effect.
13. Governing law and jurisdiction
These Terms are governed by the laws of Belgium. Disputes are submitted to the competent courts of Brussels, without prejudice to mandatory consumer or local law. Where these Terms are translated, the English version prevails in case of discrepancy.
